Terms of Sale
1) Seller
The seller and merchant of record for every order is ELAISSAOUI SARL, registered office Tour Main Street, 12th Floor, CFC, Casablanca 20250, Morocco, RC 615243, ICE 002747591000084, IF 52418904 (the House). The contract of sale is concluded directly between you and the House, which is named on your order confirmation and invoice.
2) Scope
These terms apply to every order placed through this store. By placing an order you accept them. The version in force when you order applies to that order.
3) Products
Our pieces are luxury goods. Some are made in limited quantity, made to order, or personalised. Small natural variations in handmade items and natural materials are inherent to the product and are not defects. Each authenticated piece is supplied with its certificate of authenticity.
4) Order and contract
The display of products is an invitation to order, not a binding offer. Your order is an offer to buy. The contract is formed when we send an order confirmation or dispatch the goods, whichever comes first. We may decline an order, for example where an item is unavailable, payment is not authorised, or we suspect fraud.
5) Prices
Prices are shown in the currency selected at checkout. For deliveries outside Morocco, import taxes and duties may apply as set out in the Shipping policy and at checkout. Title passes to you only when payment is received in full.
6) Payment
Payment is taken through our providers at the time shown at checkout. You confirm you are authorised to use the payment method.
7) Delivery
Delivery methods, times and costs are set out in the Shipping policy. Risk passes to you on delivery.
8) Withdrawal and returns
Consumers in the European Union and the United Kingdom have a statutory right of withdrawal. The conditions, the fourteen day period, the narrow exception for genuine made to order or personalised pieces, and the process are set out in the Return and refund policy, which forms part of these terms.
9) Legal guarantee
Products benefit from the legal guarantee of conformity where required by law. Nothing here limits a statutory right that cannot be limited by agreement.
10) Liability
We are liable for damage caused by intent or gross negligence and for injury to life, body or health, and otherwise only to the extent permitted by mandatory law.
11) Intellectual property
The brand, designs, content and certificates are protected. A purchase transfers ownership of the physical product only.
12) Governing law
These terms are governed by the law of Morocco. Mandatory consumer protections of the country where a consumer resides remain unaffected. For EU consumers the Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr. Contact: concierge@elaissaoui.com.
